BY INSTALLING, COPYING, OR OTHERWISE USING EDITSYNC ("SOFTWARE"),
YOU AGREE TO BE BOUND BY THE TERMS OF THIS LICENSE AGREEMENT.
IF YOU DO NOT AGREE, DO NOT INSTALL OR USE THE SOFTWARE.

1. DEFINITIONS

"Software" means the EditSync VS Code extension and CLI tool,
including all updates, patches, and documentation.

"User", "You" means the individual or entity using the Software.

"Server" means any remote system to which the Software connects
(SFTP, SSH, Docker, Kubernetes, AWS SSM, etc.).

"Local Backup" means the backup copies stored on the User's
  local machine under .vscode/editsync-backup/.

"Pro Features" means functionality requiring a valid license key,
including but not limited to: backup, conflict detection, trash
recovery, server diff comparison, multi-server profiles, and
  change export.

2. GRANT OF LICENSE

2.1 The Software is licensed, not sold. Subject to the terms of
this Agreement, You are granted a non-exclusive,
non-transferable, revocable license to use the Software for
      personal or internal business purposes.

2.2 Free tier users may use basic upload/download functionality
      with a single server connection.

2.3 Pro tier users may use all features subject to a valid
license key obtained through the official purchase channel
      (https://buy.polar.sh/polar_cl_0j9mA5nJZ0IiC4Rg91DrxyUHn8ZvpUTW1KK9q0xWrHy).

2.4 Trial: A 14-day trial of Pro features is provided upon first
installation. After expiration, Pro features are locked until
      a license key is activated.

3. RESTRICTIONS

  You may NOT:
    a) Copy, modify, merge, or create derivative works of the
       Software or its obfuscated portions
    b) Reverse engineer, decompile, disassemble, or attempt to
       derive the source code
    c) Redistribute, sublicense, sell, rent, lease, or transfer
       the Software or license keys
    d) Remove or alter any proprietary notices, labels, or marks
    e) Use the Software to build a competing product or service
    f) Share, publish, or transfer license keys to third parties
    g) Circumvent or attempt to circumvent any license protection
mechanisms, trial limitations, or feature restrictions

4. DATA HANDLING AND PRIVACY

4.1 FILE DATA: The Software transmits file contents solely
between Your local machine and Your designated Server(s)
via encrypted SSH/SFTP connections. File contents are NEVER
transmitted to EditSync, Polar.sh, or any third party.

4.2 LICENSE VALIDATION: The Software sends the following to
Polar.sh (https://api.polar.sh) for license validation only:
        — License key
        — Machine hostname and platform identifier
        — Organization ID
No file data, file names, server addresses, or credentials
      are transmitted.

4.3 NO TELEMETRY: The Software does not collect usage analytics,
crash reports, or telemetry data of any kind.

4.4 LOCAL STORAGE: The Software stores the following on Your
      local machine (~/.editsync/):
        — Encrypted trial state and installation marker
        — License cache (HMAC-signed, machine-bound)
        — Server connection history (for Free tier limits)
These files contain no file data or credentials.

4.5 CREDENTIALS: SSH credentials (passwords, private keys,
passphrases) are handled by the underlying SSH library and
are NOT stored, logged, or transmitted by the Software
beyond the direct server connection. Users are solely
responsible for securing their SSH credentials and config
      files.

5. BACKUPS AND DATA STORAGE

5.1 LOCAL ONLY: All backups created by the Software are stored
exclusively on the User's local machine in the workspace
directory (.vscode/editsync-backup/). The Software does NOT
provide cloud backup, remote backup, or any off-site backup
      functionality.

5.2 USER RESPONSIBILITY: The User is solely responsible for:
        — Maintaining independent backups of all critical data
        — Verifying backup integrity before relying on them
        — Securing the local machine where backups are stored
        — Understanding that local backups are lost if the local
machine is lost, damaged, reformatted, or stolen

5.3 RETENTION: Backups are subject to automatic retention limits
(configurable, default 10 per file). Older backups are
permanently deleted when the limit is exceeded. Trash items
are permanently deleted after the retention period (default
7 days). THESE DELETIONS ARE IRREVERSIBLE.

5.4 FREE TIER: Free tier users do NOT have access to backup,
conflict detection, or trash recovery features. Free tier
usage on production servers is AT THE USER'S OWN RISK.
EditSync strongly recommends Pro tier for any environment
where data loss would be consequential.

5.5 NO GUARANTEE: The Software does not guarantee that backups
will be created successfully in all circumstances. Network
failures, disk space limitations, permission errors, or
software bugs may prevent backup creation. Users must not
rely on EditSync as their sole backup mechanism.

6. LIMITATION OF LIABILITY AND DISCLAIMER OF WARRANTIES

6.1 AS-IS: THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE",
WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING
BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY,
FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

6.2 NO WARRANTY OF RELIABILITY: EDITSYNC DOES NOT WARRANT THAT:
        — The Software will be uninterrupted or error-free
        — File synchronization will always complete successfully
        — Backups will always be created before overwrites
        — Conflict detection will identify all server changes
        — Data will not be lost, corrupted, or overwritten
        — The Software will be compatible with all server
          configurations, network environments, or SSH
          implementations

6.3 DATA LOSS: IN NO EVENT SHALL EDITSYNC, ITS AUTHORS,
CONTRIBUTORS, OR LICENSORS BE LIABLE FOR ANY LOSS OF DATA,
      INCLUDING BUT NOT LIMITED TO:
        — Files overwritten on the server due to sync operations
        — Files deleted from the server (even with trash enabled)
        — Backup files lost due to local machine failure
        — Data corruption caused by interrupted transfers
        — Loss resulting from conflict resolution choices
        — Loss resulting from configuration errors
        — Loss resulting from Free tier limitations (no backup,
no conflict detection, no trash recovery)

6.4 LIMITATION: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE
LAW, IN NO EVENT SHALL EDITSYNC BE LIABLE FOR ANY INDIRECT,
INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES,
      INCLUDING BUT NOT LIMITED TO:
        — Loss of profits or revenue
        — Loss of data or business information
        — Business interruption
        — Cost of procurement of substitute services
REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF
LIABILITY, EVEN IF EDITSYNC HAS BEEN ADVISED OF THE
      POSSIBILITY OF SUCH DAMAGES.

6.5 MAXIMUM LIABILITY: EDITSYNC'S TOTAL CUMULATIVE LIABILITY
ARISING FROM OR RELATED TO THIS AGREEMENT SHALL NOT EXCEED
THE AMOUNT ACTUALLY PAID BY YOU FOR THE SOFTWARE IN THE
TWELVE (12) MONTHS PRECEDING THE CLAIM. FOR FREE TIER
USERS, THIS AMOUNT IS ZERO ($0).

6.6 ESSENTIAL PURPOSE: THE LIMITATIONS IN THIS SECTION SHALL
APPLY EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL
      PURPOSE.

6.7 JURISDICTIONAL VARIATIONS: SOME JURISDICTIONS DO NOT ALLOW
THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL
DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN
SUCH JURISDICTIONS, EDITSYNC'S LIABILITY SHALL BE LIMITED
TO THE GREATEST EXTENT PERMITTED BY LAW.

7. USER RESPONSIBILITIES AND ACKNOWLEDGMENTS

BY USING THE SOFTWARE, YOU ACKNOWLEDGE AND AGREE THAT:

7.1 You are solely responsible for all data on Your server(s)
      and local machine.

7.2 You will maintain independent backups of all critical data
through means separate from the Software.

7.3 You understand that file synchronization carries inherent
risks, including the possibility of data loss or corruption.

7.4 You will verify the Software's behavior in a non-production
environment before using it on production servers.

7.5 You will review and understand the sync configuration
      (.vscode/editsync.json) before initiating any connection.

7.6 You are responsible for ensuring that Your use of the
Software complies with all applicable laws, regulations,
      and Your organization's security policies.

7.7 You are responsible for securing SSH credentials, private
keys, and config files used with the Software.

7.8 You understand that the "Server is Source of Truth"
principle means: initial sync downloads FROM the server,
and subsequent saves upload TO the server. Misconfiguration
      may result in unintended overwrites.

8. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless EditSync, its
authors, contributors, and licensors from and against any claims,
liabilities, damages, losses, and expenses (including reasonable
  legal fees) arising from:
    a) Your use or misuse of the Software
    b) Your violation of this Agreement
    c) Your violation of any applicable law or regulation
    d) Any data loss or damage resulting from Your use of the
       Software

9. THIRD-PARTY COMPONENTS

  9.1 The Software uses open-source libraries (ssh2, ssh2-sftp-client,
and others) subject to their respective licenses. EditSync
does not warrant the functionality, security, or reliability
      of third-party components.

9.2 License validation is provided through Polar.sh
      (https://polar.sh). Availability of license validation
depends on Polar.sh service availability. A 7-day offline
grace period is provided for connectivity interruptions.

9.3 EditSync is not responsible for any changes, outages, or
      discontinuation of third-party services.

10. PRO LICENSE AND PAYMENT TERMS

10.1 License keys are non-transferable and bound to a single
       user and machine.

10.2 License keys may be revoked for violation of this Agreement
or at the discretion of EditSync.

10.3 EditSync reserves the right to modify Pro features, pricing,
and tier definitions with reasonable notice. Existing paid
subscribers will be notified at least 30 days in advance
       of pricing changes.

10.4 PAYMENT: Pro subscriptions are billed through Polar.sh.
By purchasing, You agree to Polar.sh's Terms of Service
       (https://polar.sh/legal/terms).

  10.5 REFUND POLICY:

       a) 14-Day Money-Back Guarantee: If You are unsatisfied with
Pro for any reason, You may request a full refund within
14 days of initial purchase by contacting
          eorud0713@gmail.com.

       b) After 14 days, refunds are issued at EditSync's
          discretion on a case-by-case basis.

       c) Upon refund, Your license key is immediately revoked
and Pro features are deactivated. You will revert to
Free tier. Any data created using Pro features (backups,
trash, sync history) will remain on Your local machine
but will no longer be accessible through the Software.

       d) Refund processing is handled by Polar.sh. Processing
time depends on Your payment method (typically 5-10
          business days).

       e) Annual subscriptions may be refunded pro-rata within
30 days of purchase, or in full within 14 days.

10.6 CANCELLATION: You may cancel Your subscription at any time.
Pro features remain active until the end of the current
billing period. No partial refunds for unused time on
       monthly plans.

11. TERMINATION

11.1 This license is effective until terminated.

11.2 This license automatically terminates if You violate any
       restriction in Section 3.

11.3 Upon termination, You must cease all use and destroy all
       copies of the Software.

11.4 Sections 5 (Backups), 6 (Limitation of Liability),
7 (User Responsibilities), 8 (Indemnification), and
       12 (Governing Law) survive termination.

12. GOVERNING LAW

This Agreement shall be governed by and construed in accordance
with the laws of the Republic of Korea, without regard to its
conflict of law provisions. Any disputes arising under this
Agreement shall be subject to the exclusive jurisdiction of the
courts of the Republic of Korea.

13. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between You and
EditSync regarding the Software and supersedes all prior
  agreements, understandings, and communications.
